CONSUMER GUARANTEES ACT:

a. If the Consumer either acquires or holds himself or herself out as acquiring the components for the purpose of a business then the provisions of the Consumer Guarantees Act 1993 shall not apply to the supply of the components by QuickBuild Homes.

b. The Consumer has not made known, either expressly or by implication, to QuickBuild Homes any particular purpose for which the components are being acquired other than purposes for which components of the type in question are commonly supplied as part of a domestic building contract using QuickBuild Homes components and in terms of this specification.

c. There has been no representation to the Consumer that the components are or will be fit for any purpose other than the purposes for which they are commonly supplied as part of a domestic building contract using QuickBuild Homes components under the terms of this specification.

d. The Consumer is required, when ordering a kit-set, to specify the exposure zone or environment referred to in NZS 3604:2011 for the building to be erected from the components. This is vital information so that correctly specified components can be supplied for that exposure zone or environment. If the Consumer does not specify the exposure zone or environment when ordering the components, QuickBuild Homes will supply the components for an exposure zone other than sea spray zone and an environment which is not within 50 metres of a geothermal hot spot.

e. The QuickBuild Homes components are supplied for erection into a building to be located in the exposure zone or environment specified when the order is placed. If the components are erected into a building located in a more severe exposure zone or environment, or if the building once erected is transported to an exposure zone or environment more severe than the one for which the components are supplied, then some of the components may not meet the period of durability specified for that component, even with normal use and normal maintenance because they are in a more severe exposure zone or environment.

MAINTENANCE REQUIREMENTS:

In all zones and environments normal maintenance of a building erected from the specified components is as specified. Without limiting the normal maintenance requirements specified elsewhere, important maintenance requirements are:

a. Adequate ventilation of the building so as to prevent the build-up of internal moisture;

b. Maintaining the building in a weatherproof condition;

c. Protection of all exposed surfaces from moisture and damage in accordance with standard building practice;

d. Application and maintenance of protective coatings required twice a year. [Refer Important Information 9.f.];

e. Exposed metal surfaces (even if they are covered with a protective coating) should be washed at least every 12months with fresh, clean, iron and copper-free water and a soft brush. (Iron and copper is normally found in bore water, and filters are available to extract this from the water). This includes roofs, aluminium joinery and sheathing. Areas which are sheltered from rain washing should be washed at least every six months with fresh, clean, iron and copper-free water and a soft brush;

f. Exposed nail plates and metal fasteners are to be covered with a protective coating of petroleum grease and every 5 years thereafter, greased again with petroleum grease or with an equivalent product so that the exposed metal surfaces are protected;

g. For sea spray zones or environments within 50 metres of a geothermal hot spot, in addition to the normal maintenance specified, a. to g. above, normal maintenance in these zones or environments would include: Exposed metal surfaces (even if they are covered with a protective coating) should be washed at least every 6 months with fresh, clean, iron and copper-free water and a soft brush. This includes roofs, aluminium joinery and sheathing. Areas which are sheltered from rain washing should be washed more frequently with fresh, clean, iron and copper-free water and a soft brush.

AVAILABILITY OF INFORMATION TO BUILDING OWNER:

The person obtaining the specified components from QuickBuild Homes must ensure that a copy of this specification is passed on to the owner of the building, and the owner must ensure that the Specification is are passed on through the chain of ownership, so that it always remains with the owner of the building, so that the owner of the building from time to time will be aware of the provisions of this specification and of the on- going maintenance requirements associated with the components.

GENERAL:

Timber Treatment (complies with NZS 3602:2003): Where timber is treated, it will be treated as class H3.1 for sawn timber as provided in NZS 3640:2003. Light Organic Solvent Preservatives or Boron preservative – Class H1, H1.2, H3 and H3.1: LOSP treatment is applied by double vacuum pressure application to the timber. Boron treatment is applied by pressure treatment, spraying or dippingPowder coating: Given that there can be batch variations in powder coated colour, the colour shall match the corresponding master standard and be within less than or equal to 1.5 Delta E units of the master standard when measured on an approved colour computer – C.I.E. Lab System.

MISCELLANEOUS:

The QuickBuild Homes Building System is protected by patents (pending), copyrights, design registrations and trademarks. These are available upon request. This specification is a general guide and is not to be treated as a substitute for detailed technical advice in relation to environments which are more severe than those specified in NZS 3604:2011. If the components are not handled, stored, erected, used and maintained in accordance with this specification, QuickBuild Homes is not liable for any loss or damage suffered. QuickBuild Homes is not liable if any technical advice obtained independently of QuickBuild Homes is deficient.

ADHESIVES:

Melamine Urea Formaldehyde adhesives are used for bonding structural wooden components for use on products that are completely protected from elements, i.e. internal use and protected from the weather. They may also be used for bonding non- structural wooden components that are exposed to the weather.

IMPORTANT INFORMATION:

a. In general, the quality of material and standard finish for QuickBuild Homes components will be within the limits of the specification. QuickBuild Homes is the manufacturer of QuickBuild Homes building components. QuickBuild Homes sells components you, the client. Any responsibility of QuickBuild Homes in any area, is confined solely to components supplied by QuickBuild Homes. There are normally materials in and outside every building, which are others (such as concrete, external services etc., and not by QuickBuild Homes

b. QuickBuild Homes fabricates components for erection in accordance with the consented plans that accompany an order placed by you, these consent documents will be provided by a licensed designer. Any changes made after placing the order will be the responsibility of you to update the consent documents to ensure that any changes do not compromise the structure of the building. QuickBuild Homes has no responsibility for any changes made.

c. QuickBuild Homes is not responsible for any component or product erected from components that have been altered by a builder, or any other person so that the component or product is outside the then current QuickBuild Homes specifications, plans, enhancements or additions.

d. Components produced for Kit set will be designed to suit 50 metres per second (very high) wind speeds. Where topography, elevation or degree of exposure of the building site results in higher wind speeds than contained in NZS 3604:2011, special engineering calculations will be required. Any specifications or maintenance requirements for a specific set of components which have been obtained from QuickBuild Homes to be erected in an environment which is not specified in NZS 3604: 2011 must be made available to the owner and subsequent owners of the building from time to time in the same manner as provided for in this specification.

e. QuickBuild Homes is not in any way responsible for applying for or gaining Building and / or Resource Consents. The QuickBuild Homes houses have a Multiproof, pre-approved Building Consent for the building, but this does not you the land owner permission to build the house on their land without consent from a Building Consent Authority. A Building Consent to build the house will include distances to boundaries and service layouts and other information.


DELAYS IN GETTING BUILDING CONSENT:

Notwithstanding the terms and conditions laid out in any of the following documents:

·         Supply Agreement
·         Kitset Supply Agreement
·         Kitset Residential Building Contract

QuickBuild Homes will refund the full amount of any deposits paid, less non-recoverable, and/or reasonable administration, costs, if building consent is denied by council as a direct result of any action or inaction by QuickBuild Homes.

PLEASE NOTE

YOU ARE RESPONSIBLE FOR YOUR BUILDING CONSENT. NONE OF THE AFOREMENTIONED DOCUMENTS ARE DEPENDANT ON YOU RECEIVING BUILDING CONSENT. IF THERE ARE DELAYS WITH COUNCIL OR PROBLEMS WITH ANYTHING NOT DIRECTLY RELATED TO OUR PRODUCTS OR SERVICES, THE AGREEMENTS ARE STILL BINDING AND YOU MAY HAVE TO COVER COSTS INCURRED BY QUICKBUILD HOMES RELATING TO THE DELAYS OR BREACH OF CONTRACT. QUICKBUILD HOMES ARE NOT RESPONSIBLE FOR THE QUALITY OF GOODS WHICH ARE NOT STORED ON THEIR BUSINESS PREMISES(I.E. STORED IN A FREIGHT YARD OR ON SITE) SO YOU MUST ENSURE YOU ARE SATISFIED WITH THE QUALITY OF THE MATERIALS BEFORE THEY ARE SHIPPED AND THEREBY BECOME YOUR LEGAL PROPERTY.  EVEN IF YOU DO NOT HAVE CONSENT YOU WILL STILL BE UNDER OBLIGATION TO PAY FOR THE MATERIALS UPON COMPLETION OF MANUFACTURE.FAILURE TO DO SO WILL RESULT IN LATE FEES. YOUR CONTAINER WILL BE DETAINED UNTIL ALL AMOUNTS OWING, INCLUDING FEES, HAVE BEEN PAID IN FULL.                              

UNABLE TO FINANCE CONTRACT:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

In the event that you are unable to obtain finance in order to pay the deposit amount on a signed contract, assuming that no significant costs have been incurred relating to the signed contract, QuickBuild Homes will accept your request to cancel the contract.

All products for which materials have been ordered, manufactured, and/or shipped will be handled on a case-by-case basis.


QUICKBUILD HOMES - SERVICES PROVIDED WITHOUT CHARGE:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

QuickBuild Homes will offer up to 2 hours of administrative work without charge. Administrative work includes, but is not limited to:

  • Phone calls

  • Emails

  • Research

  • Contractual changes/adjustments

  • Quotations

QuickBuild Homes reserve the right to invoice you for the additional work at our standard hourly rate, with a minimum charge of 30 minutes over and above the 2 hour limit.

Any invoices created in accordance with the above paragraph will be reversed on final payment and acceptance of the product specified in the contracts.

Administrative work does NOT include the following, which is billable before being undertaken:

  • Building Consent Applications

  • Site Plans

  • Rendering work

  • Graphics work

  • Design work

  • Architectural work

  • Engineering work

FREIGHT COSTS:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

The Freight Quote we send you includes the following costs:

  • Swing lift from freight yard onto truck

  • Container from Palmerston North to QuickBuild Homes

  • Swing lift onto QuickBuild Homes’ business premises

  • Truck return trip to Palmerston North

  • 1 week container hireage at QuickBuild Homes

  • Truck from Palmerston North to QuickBuild Homes business premises

  • Swing lift from QuickBuild Homes business premises on to truck.

  • Container return to Palmerston North.

  • Swing lift from truck on to freight yard

  • Rail booking to depot other than Palmerston North (where applicable)

  • Swing lift on to rail car (where applicable)

  • Swing lift from rail car to local depot freight yard (where applicable)

  • Swing lift from freight yard on to truck

  • Container from local depot to site

  • Swing lift from truck to on-site

  • Truck return trip to local depot

  • 3 weeks hireage of container.

  • Truck trip to site

  • Swing lift from site on to truck

  • Container return to local depot

  • Swing lift on to freight yard

  • Fuel Adjustment Factor

QuickBuild Homes will not accept alternative freight arrangements or provide price comparisons.
QuickBuild Homes is not liable for differences in freight pricing which may occur between when we first provided estimates, and when the bill we send to you for the freight falls due.

HOW FREIGHT WORKS:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

QuickBuild Homes will get a freight price at the quotation stage.

You will be invoiced for the freight, plus a one month storage bond in case of an unplanned retention of the container. This must be paid before the shipping of the container.

Any time exceeding the agreed time frame for holding of the container by you will be billed to you immediately, at a minimum charge of one month’s storage fees.

In the event that this bill remains outstanding, the amount will be deducted from the bond daily.

In the event that the bond is no longer sufficient to cover the cost of the storage fees and the bill remains outstanding, QuickBuild Homes reserve the right to cancel the contract without refunding any amounts paid.

Should the container be returned in the agreed time frame, all advance payments on storage will be refunded to you within 14 days of a confirmed consignment note from the freight company.


YOUR RIGHTS TO USE PLANS PROVIDED BY US:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

QuickBuild Homes is and will remain the exclusive owner everywhere in the world of all Intellectual Property rights and interests in the Kitset Units and related products and services.

The use of QuickBuild Homes intellectual property outside of the scope of the above clause may result in legal action being taken by QuickBuild Homes.

This means that all information, including but not limited to the plans and specifications, provided to you do not belong to you at any stage but are provided for one-time only use in relation to the purchased products and/or services. This includes a one-time only use for building consent applications.


CHANGES TO PLAN LAYOUT:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

In short, yes you can.

Changes to specifically engineered designs can be time-consuming and costly, however some people like to put their own touch on a house or to adapt it slightly for their specific application.

As a result, QuickBuild Homes can offer design and architectural changes, provided that these changes are clearly explained by you.

QuickBuild Homes will provide a quote on the design work, which must be paid in advance along with a deposit on materials and a signed and confirmed contract.

Work exceeding the scope of the quote will be billed at our standard hourly rate. As such, we advise that you get all your changes sorted before you request a customised design quote.

QuickBuild Homes is and will remain the exclusive owner everywhere in the world of all Intellectual Property rights and interests in all plans, specifications and related documentation and products produced during this process.


BUILDING TIME FRAMES:

Notwithstanding the terms and conditions laid out in any of the aforementioned sections:

While directly-sub-contracted assemblers can complete their work in the times advertised, we would anticipate self-builds and assisted builds to take longer (i.e. if you are buying a "Kit Set Materials Only" or "Materials + Lock-up Shell" package)

QuickBuild Homes will not be held liable in any way for the length of time taken to complete the work that has not been undertaken by their own subcontractors as it is not possible to guarantee the speed or quality of workmanship of yourself, your friends, family or even other builders, including those recommended by them, if they are not directly contracting to QuickBuild Homes.

In summary, we will only be liable for work undertaken by our sub-contracted assemblers.

Compensation is not offered on jobs for which QuickBuild Homes are not liable.
